These Terms of Service govern purchases made directly from Gloss Syndicate Ltd through our website, Instagram Shop, Facebook Shop, social-media sales channels or another online sales channel that refers to these Terms.
Please read these Terms before placing an order. By placing an order, you confirm that you have read and accepted them. Nothing in these Terms limits any mandatory rights available to you under applicable consumer law.
1. About us and these Terms
Gloss Syndicate Ltd supplies vehicle cleaning, detailing, maintenance and car-care products, together with related accessories.
A “consumer” is an individual purchasing wholly or mainly for purposes outside their trade, business, craft or profession. References to “you” and “your” mean the person placing the order. References to “we”, “us” and “our” mean Gloss Syndicate Ltd.
Product descriptions, prices, delivery information and safety information shown on the relevant product page form part of the contract between you and us.
2. Instagram, Facebook and other platforms
Instagram, Facebook and other third-party platforms provide sales, communication or payment technology. Unless expressly stated otherwise, the contract for the sale of our products is between you and Gloss Syndicate Ltd.
Meta Platforms, Inc. and its affiliates are not the seller of our products and are not responsible for manufacturing, dispatch, delivery, product performance, returns or refunds.
Additional platform, checkout, payment-provider or buyer-protection terms may apply. Those terms operate in addition to, and do not remove, your mandatory rights against us as the seller.
3. Products and product information
We take reasonable care to ensure that product descriptions, images, quantities, specifications and prices are accurate. Product images are illustrative. Screen settings and lighting may affect the way colours, finishes and packaging appear.
Packaging, bottle design, colour or fragrance may vary between production batches where this does not materially affect the product’s identity, quantity, intended function or stated performance.
We may make minor changes required to comply with safety, regulatory or labelling requirements, provided those changes do not materially reduce the product’s functionality.
4. Product safety and correct use
Car-care and cleaning products must be used, stored and disposed of strictly in accordance with their label, instructions, warning statements and any applicable Safety Data Sheet.
You must:
- read the complete label before use;
- follow all dilution, application and storage instructions;
- use any stated protective equipment and ensure suitable ventilation;
- never mix products unless the instructions expressly permit it;
- keep products away from children, pets, food and drink;
- test the product on a small, inconspicuous area where recommended;
- check that the product is suitable for the relevant paint, coating, trim, wheel, glass, fabric or other surface; and
- stop using the product if an unexpected reaction occurs.
Some products may be intended only for professional users. Any such restriction will be stated on the product page or label. Safety Data Sheets will be supplied or made available where required by law.
Nothing in this section excludes our responsibility for a product that is defective, unsafe, incorrectly labelled or not as described.
5. Placing an order
Displaying a product on our website, Instagram Shop or another sales channel is an invitation to place an order and is not an acceptance of that order.
Your order constitutes an offer to purchase the selected products. An automated acknowledgement confirms that we received your order, but does not necessarily mean that it has been accepted.
A binding contract is formed when we send a dispatch confirmation or otherwise expressly confirm in writing that we have accepted your order. For an order arranged through direct messages, a contract is formed only when we issue an express written acceptance or invoice and confirm the order.
We may decline or cancel an order before dispatch if, for example:
- the product is unavailable;
- payment cannot be authorised;
- the price or description contains an obvious error;
- we cannot deliver to the requested location;
- age, identity or fraud-prevention checks cannot be completed;
- the order breaches applicable shipping or product-safety restrictions; or
- we reasonably suspect fraud, misuse or unauthorised resale.
If payment has already been taken for an order we do not accept, the amount paid will be refunded.
6. Prices and payment
Prices are shown in the currency stated on the product page or at checkout. Applicable taxes and delivery charges will be displayed before you submit an order.
If we discover an obvious pricing error, we may contact you for instructions or cancel the affected order and issue a refund. We are not required to supply a product at an obviously incorrect price where the error should reasonably have been recognised.
Payment must be made using a payment method offered at checkout. Payments may be processed by Meta or another independent payment provider under that provider’s own terms and privacy notice.
Discount codes and promotional offers are subject to their stated conditions, availability and expiry dates. Unless expressly stated, promotions cannot be combined or exchanged for cash.
7. Delivery
Available delivery destinations, charges and estimated delivery periods will be displayed before you place an order.
We will deliver within the period agreed with you. Where no separate period has been agreed, UK consumer orders will normally be delivered without undue delay and no later than 30 days after the contract is formed.
Delivery dates are estimates unless we have expressly agreed that a particular date is essential. If a material delay occurs, we will contact you and provide any cancellation or refund rights required by law.
You are responsible for supplying a complete and accurate delivery address. Additional costs caused by an incorrect or incomplete address may be charged where permitted by law.
Risk of loss or damage passes to a consumer when the products are physically received by the consumer or a person nominated by them. Ownership passes once full payment has been received.
International orders
International availability depends on product classification, destination and carrier restrictions. Certain liquids, aerosols, flammable products or other regulated goods may not be available for international delivery.
Where import duties, local taxes or customs charges are not included in the checkout price, this will be indicated before purchase where required. You may be responsible for charges imposed by the destination country.
8. Consumer right to cancel
If you are a consumer purchasing online or through Instagram, Facebook, telephone or another distance-selling method, you normally have the right to cancel without giving a reason.
The cancellation period begins when the contract is formed and expires 14 days after the day on which you, or a person nominated by you, receives the products. If one order is delivered in separate shipments, the period normally expires 14 days after the day on which the final item is received.
To cancel, send us a clear statement before the cancellation period expires. You may contact us atstore@gloss-syndicate.com, write to our registered office, or use the model cancellation form at the end of these Terms.
Include your name, order number, contact details and the products you wish to cancel. You do not have to use the model form or provide a reason.
Exceptions
The statutory right to cancel may not apply to:
- products made to your specifications or clearly personalised;
- products liable to deteriorate or expire rapidly;
- sealed products that are genuinely unsuitable for return for health-protection or hygiene reasons once unsealed;
- products that have become inseparably mixed with other items after delivery; or
- any other product covered by a statutory cancellation exception.
Opening packaging does not automatically remove your rights unless a statutory exception genuinely applies. These exceptions do not remove your rights where a product is faulty, unsafe or not as described.
9. Returning cancelled products
After notifying us of cancellation, you must return the products without undue delay and no later than 14 days after telling us that you wish to cancel.
Contactstore@gloss-syndicate.com for the correct returns address and any product-specific transport instructions. Do not send products to our registered office unless we expressly instruct you to do so.
Unless the product is faulty, damaged, incorrectly supplied or we have agreed otherwise, you are responsible for the direct cost of return postage.
You may inspect a product as you reasonably would in a physical shop. We may reduce a refund to reflect loss in value caused by handling or use beyond what is reasonably necessary to establish the product’s nature, characteristics and functioning.
Do not return a leaking, damaged, opened or potentially hazardous product through an ordinary postal service without contacting us. We will provide appropriate instructions. You must comply with carrier restrictions and dangerous-goods transport rules.
10. Refunds following cancellation
We will refund payments received for the cancelled products, including the cost of our least expensive standard delivery option. Additional amounts paid for premium or express delivery are not refundable beyond the cost of standard delivery.
We may withhold the refund until we receive the returned products or you provide evidence that they have been sent back, whichever occurs first.
The refund will be made without undue delay and normally within 14 days after the relevant return or evidence is received. Refunds will be made using the original payment method unless another method is expressly agreed.
11. Faulty, damaged or incorrectly supplied products
Products supplied to UK consumers must be of satisfactory quality, fit for any purpose made known to us and match their description. Your statutory rights apply in addition to any commercial guarantee.
UK consumers may have a short-term right to reject faulty goods within 30 days of delivery. After that period, statutory rights may include repair, replacement, a price reduction or a final right to reject, depending on the circumstances.
If a product arrives damaged, leaks in transit, is incorrect or appears defective, contactstore@gloss-syndicate.com as soon as reasonably possible. Photographs of the packaging, batch code and affected product may help us investigate, but requesting photographs does not remove your statutory rights.
Where a return is required because a product is faulty, damaged or incorrectly supplied, we will pay or reimburse reasonable return costs and provide instructions appropriate to the product.
We are not responsible for damage caused solely by misuse, incorrect dilution, mixing products contrary to instructions, unsuitable storage, use on a clearly excluded surface, unauthorised modification or failure to follow prominent safety warnings.
12. Restricted and regulated products
Certain chemical or corrosive products may be subject to age, identity, storage, transport or delivery restrictions. Where a product is age-restricted, you must meet the stated minimum age and may be required to complete an age-verification check.
We may refuse or cancel an order if we cannot lawfully supply, transport or deliver a regulated product. Any payment taken for an unfulfilled order will be refunded.
13. Results and compatibility
Product results may vary depending on the vehicle’s condition, existing coatings, contamination, water quality, application method, temperature and other conditions outside our control.
Any performance promise stated in the product description remains binding. However, we cannot guarantee a particular cosmetic result where the product is used outside its stated purpose or contrary to its instructions.
14. Our responsibility to consumers
If we breach these Terms or fail to use reasonable care and skill, we are responsible for loss or damage that is a foreseeable result of that breach or failure.
We are not responsible for loss that was not foreseeable, or for business losses suffered by a consumer, including loss of profit, revenue, contracts or business opportunity.
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- defective products where liability cannot legally be limited;
- breach of your mandatory statutory rights; or
- any other liability that cannot lawfully be excluded or limited.
15. Business customers
These Terms are primarily intended for consumer purchases. If you purchase products wholly or mainly for use in a trade, detailing business or other profession, you are acting as a business customer and should tell us before ordering.
Consumer-specific cancellation rights and remedies do not apply to business purchases. Separate trade terms may apply. Professional users are responsible for following applicable workplace chemical, storage, risk-assessment and Safety Data Sheet requirements.
16. Intellectual property
All trademarks, brand names, product names, graphics, photographs, videos, packaging designs, website content and other intellectual property belonging to Gloss Syndicate Ltd may not be copied, reproduced, modified or used commercially without prior written permission.
Purchasing a product does not transfer any intellectual-property rights in the product branding, formulation, design or associated content.
17. Privacy
We process personal information in accordance with ourPrivacy Policy. Instagram, Meta, payment providers and delivery companies may also process information under their own privacy notices.
18. Events outside our reasonable control
We are not responsible for delay or failure caused by an event outside our reasonable control, including severe weather, transport disruption, carrier restrictions, customs delays, industrial action, supply-chain disruption or failure of a third-party platform.
We will take reasonable steps to minimise the effect of such an event. If a delay becomes substantial, you may cancel the affected order and receive a refund for products not supplied, where required by law.
19. Complaints
Please send complaints tostore@gloss-syndicate.com and include your order number and a clear description of the issue. We will try to resolve the complaint fairly and within a reasonable period.
If a consumer dispute cannot be resolved directly, we will provide information about any applicable alternative dispute-resolution procedure where legally required. This does not restrict your right to pursue a legal remedy.
20. Changes to these Terms
We may update these Terms to reflect changes to our business, products, platforms or applicable law. The version in force when your order is accepted will normally govern that order.
21. Governing law and jurisdiction
These Terms and contracts between you and us are governed by the laws of England and Wales.
If you are a consumer resident in another part of the United Kingdom or another country, you retain the benefit of any mandatory consumer protection provided by the law of your country of residence. You may bring proceedings in any court available to you under mandatory law.
Business customers agree that the courts of England and Wales have exclusive jurisdiction, unless otherwise agreed in writing.
22. Other important terms
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.
A delay in enforcing a right does not waive that right. We may transfer our rights and obligations where this does not reduce a consumer’s rights. You may transfer your rights only where permitted by law or with our written agreement.
No person other than you and Gloss Syndicate Ltd has a right to enforce the contract, except where applicable law provides otherwise.
23. Model cancellation form
Complete and return this form only if you wish to cancel the contract. You may also cancel by sending any other clear statement.
